1. Overview

These Terms & Conditions ("Agreement") govern access to and use of the Hompwr platform, software, and related tools and services ("Service") provided by HOMPWR, LLC ("Hompwr," "we," "us," or "our"). By creating an account, purchasing a subscription, or using any part of the Service, you ("User," "you") agree to these Terms. If you do not agree, do not use the Service.

2. Nature of Service

Hompwr provides a digital presentation and analytics platform designed for licensed mortgage loan officers ("LOs") and real estate agents ("Realtors"). Hompwr is not a lender, broker, or real estate brokerage, does not originate or fund loans, and does not engage in real estate transactions. All loan, rate, and approval information displayed through the Service is generated and controlled by the licensed User.

3. Eligibility and Account Types

Hompwr's services are designed for use by mortgage and real-estate professionals, as well as their clients.

  • Loan Officers: Intended for individuals who are appropriately licensed to originate mortgage loans in their jurisdictions.
  • Realtors: Intended for individuals who are appropriately licensed to represent buyers or sellers of real estate in their jurisdictions.
  • Admin or Team Accounts: May manage multiple users associated with a branch or company.
  • Consumers: May receive and view quotes or presentations without creating an account.

Hompwr does not independently verify professional licensing status. By using the platform, you represent that the information you provide is accurate and that your use complies with applicable licensing and regulatory requirements.

4. Subscriptions and Fees

  • Subscription fees apply to Loan Officer accounts for access to premium quoting tools.
  • Subscriptions are billed monthly, with an optional discounted annual prepayment.
  • Fees are non-refundable, except for the 90-day money-back guarantee available to first-time subscribers only.
  • Refund requests must be sent to [email protected] within 90 days of the initial subscription date.
  • Hompwr reserves the right to modify pricing upon renewal or by prior notice.

5. License and Acceptable Use

Hompwr grants you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You may not:

  • Reverse engineer, copy, or resell any part of the Service;
  • Misrepresent data or present quotes in a deceptive or non-compliant way;
  • Use the Service to violate any federal, state, or local laws or licensing requirements;
  • Share login credentials or access with unlicensed persons;
  • Post or transmit unlawful, defamatory, or misleading content.

6. Compliance Responsibility

Each LO and Realtor is solely responsible for ensuring compliance with all applicable laws, including TILA/RESPA, Reg Z, SAFE Act, Equal Housing, and all state licensing rules. Hompwr provides tools to assist compliance but assumes no responsibility for Users' representations, quotes, or communications.

7. Data and Privacy

Use of the Service is subject to Hompwr's Privacy Policy. Users may upload client data only with proper consent. Currently, Hompwr does not collect personally identifiable information ("PII") from consumers; future versions of the Service may do so in accordance with updated privacy terms. Hompwr may collect, retain, and use anonymized or aggregated data for analytics, industry reporting, and resale.

7A. Feature-Specific Processing: Mortgage Statement Data-Capture

HOMPWR, LLC ("Hompwr") offers an optional feature that extracts only the following values from an uploaded mortgage statement to prefill calculators: interest rate, monthly escrow dues, monthly interest amount, monthly principal amount, payment due date, property address, remaining balance, and total payment due. Hompwr does not retain consumer names, full account numbers, Social Security numbers, dates of birth, or the full statement image beyond transient processing necessary to perform extraction.

  • Purpose. Extracted Values are used solely to assist Users in preparing illustrative estimates (not a credit decision, commitment, or offer).
  • Retention. Anonymized Extracted Values may be retained for quality assurance, separate from "user-level" Extracted Values which are retained in a user's quote, which can be removed at will. Statement images and raw OCR text are handled transiently and not retained beyond extraction.

7B. User Responsibilities; Prohibited Uploads

Users (including LOs and their support staff) are solely responsible for (i) obtaining any consumer authorization required by law or company policy before uploading a statement, (ii) verifying accuracy of extracted data prior to sharing results, and (iii) complying with all applicable laws, regulations, and company policies.

Prohibited uploads include:

  • Social Security numbers, full bank/credit-card numbers, dates of birth, or any sensitive data not necessary for extraction.
  • Users must not upload documents for any individual who has not provided authorization.

7C. Regulatory Compliance; Advertising

Estimates produced with this feature may trigger obligations under TILA/Reg Z, UDAAP, ECOA/Reg B, GLBA/Reg P, the FTC Safeguards Rule, and applicable state privacy laws. Users are responsible for ensuring any private or public presentation (including marketing/social media) is accurate, fair, and includes required disclosures (e.g., APR when trigger terms are used).

7D. Role; Processor

For enterprise lenders and mortgage companies, and for LOs operating through such companies, Hompwr acts as a service provider/processor under the client's documented instructions. Consumers should exercise applicable privacy rights through their lender or loan officer's company. Hompwr will reasonably assist clients with verified requests consistent with our processor role and limited retention.

7E. Logging; Security; Subprocessors

Use of the feature may be logged (e.g., user ID, timestamp, client or branch, lead ID, metadata) for audit and security. Hompwr maintains an information security program appropriate to the data's sensitivity (including encryption in transit/at rest, RBAC, logging/monitoring, vulnerability management, secure SDLC, and incident response). Hompwr may utilize vetted subprocessors (e.g., OCR or cloud hosting) under contracts no less protective than Hompwr's client agreements. A current subprocessor list is available upon request.

8. Data Retention and Termination

  • Hompwr reserves the right to retain or delete data at its discretion.
  • Upon termination, Users lose access to stored data and records.
  • Anonymized or aggregated data remains property of Hompwr.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available." Hompwr makes no warranty of uninterrupted operation, accuracy of data, or fitness for a particular purpose. Hompwr does not verify, endorse, or guarantee the accuracy of any quote or information produced by a User.

In no event will Hompwr, LLC, its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to use of the Service.

10. Indemnification

You agree to defend, indemnify, and hold harmless Hompwr, LLC from any claims, damages, liabilities, and expenses (including attorneys' fees) arising out of or relating to:

  • Your use or misuse of the Service;
  • Your breach of this Agreement; or
  • Your violation of any laws, regulations, or third-party rights.

11. Arbitration and Governing Law

This Agreement and any related dispute will be governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute or claim arising out of or relating to this Agreement will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in California, unless otherwise agreed.

12. Modifications

Hompwr may update or modify these Terms at any time. Changes will be effective upon posting to the website or notification through the platform. Continued use of the Service constitutes acceptance of the updated Terms.
